The website located at materialmotion.ai (the “Site”) is operated by MaterialMotion, Inc. (“Company”, “us”, “our”, and “we”). This Privacy Policy describes how we collect, use, share, and protect personal information when you visit the Site or otherwise interact with us. It applies to visitors of the Site and to people who contact us through the Site. Use of our hosted application at app.materialmotion.ai is governed by a separate privacy notice provided at that location.

By accessing or using the Site, you acknowledge that you have read this Privacy Policy. For information on consent and your choices, see Sections 4, 8, and 9 below.

1. Information we collect

1.1 Information you provide to us

When you contact us through a form on the Site, subscribe to updates, or otherwise communicate with us, you may provide us with information such as your name, work email address, company name, job title, phone number, and the content of your message. You may also provide additional information voluntarily, for example if you attach a document or describe your use case in a free-text field.

You are not required to provide us with any personal information to browse most of the Site. If you choose not to provide requested information when contacting us, we may not be able to respond to your inquiry.

1.2 Information we collect automatically

When you visit the Site, we (and our service providers) automatically collect certain technical and usage information, including:

• Device and connection data, such as your IP address, approximate geographic location (country-level, derived at the network edge), device type, operating system, browser type and version, and screen resolution.
• Usage data, such as the pages you view, the referring URL, the links you click, the time and duration of your visit, and the content you interact with. We do not record your screen or your session.
• Error data, such as stack traces and performance metrics collected when the Site encounters an error, to help us diagnose and resolve issues. We instruct our error-monitoring provider to scrub personal information from error payloads.

1.3 Information we do not collect

We do not intentionally collect sensitive categories of personal information, such as information about race or ethnicity, political or religious beliefs, health, genetic or biometric data, sexual orientation, or precise geolocation. We do not knowingly collect information from children under the age of 18 and our Site is not directed to children. If we learn that we have collected information from a child, we will delete it.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under U.S. state privacy laws.

2. How we use your information

We use the information we collect to:

• Respond to your inquiries and provide the information or materials you request.
• Operate, maintain, secure, and improve the Site, including monitoring its performance and diagnosing errors.
• Communicate with you about our products, services, events, or company updates, where you have opted in to such communications or where permitted by applicable law.
• Understand how visitors find and use the Site so we can improve our content and design.
• Comply with legal obligations, resolve disputes, and enforce our agreements.
• Protect the rights, property, or safety of MaterialMotion, our visitors, or others.

We do not use your information to make decisions about you by solely automated means that produce legal or similarly significant effects.

3. Lawful basis (EEA, UK, and Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on one or more of the following lawful bases:

• Contract or pre-contract, where processing is necessary to respond to your request or to take steps at your request before entering into a contract.
• Legitimate interests, where processing is necessary for our legitimate interests in operating, securing, and improving the Site, or for direct B2B communications with professional contacts, and those interests are not overridden by your rights and freedoms.
• Consent, where we ask for your consent (for example, for non-essential cookies or marketing communications). You may withdraw consent at any time, as described in Section 8.
• Legal obligation, where processing is necessary to comply with a legal obligation to which we are subject.

4. How we share your information

We share personal information only as described in this Privacy Policy.

4.1 Service providers

We rely on a small set of third-party service providers to operate the Site and our business. These providers act as our processors (or in U.S. state privacy terms, “service providers” or “contractors”) and are contractually bound to use your information only as we instruct and to safeguard it. 4.2 Legal and safety disclosures

We may disclose personal information to government authorities or other third parties where we believe in good faith that disclosure is required or permitted to:

• Enforce or investigate potential violations of our Terms of Use or other agreements.
• Detect, prevent, or address fraud, security, or technical issues.
• Protect the rights, property, or safety of MaterialMotion, our visitors, or others.

4.3 Business transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will take reasonable steps to ensure that any successor honors this Privacy Policy with respect to your information.

4.4 With your direction

We may share your information with others when you direct us to do so.

5. International data transfers

We are based in the United States, and the information we collect is processed in the United States. Some of our service providers operate servers or personnel in other countries. If you access the Site from outside the United States, your personal information will be transferred to, stored in, and processed in the United States and possibly other countries.

Where required by applicable law, we use appropriate safeguards for international transfers, such as the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or equivalent mechanisms recognized under Swiss data protection law. 6. Cookies and similar technologies

A cookie is a small text file that a website places on your device. We and our service providers use cookies and similar technologies (such as pixels, local storage, and device identifiers) to operate the Site, remember your preferences, measure site performance, and understand how the Site is used.

We use only first-party cookies on the Site. We do not use third-party advertising cookies or cross-site tracking cookies. The categories of cookies and similar technologies we use are:

• Strictly necessary, which are required for the Site to function (for example, to remember your consent choices and route requests at the edge).
• Analytics, which help us understand how visitors use the Site. These are subject to consent where required by law.
• Functional, which remember preferences you have set (for example, theme).

You can manage cookies through your browser settings or, where applicable, through the “Cookie settings & privacy choices” link in the Site footer. Blocking strictly necessary cookies may cause parts of the Site to stop working.

7. Global Privacy Control and Do Not Track

Some browsers and browser extensions support a Global Privacy Control (GPC) signal, which indicates that you do not want your personal information sold or shared, and that you object to certain forms of tracking. When we detect a GPC signal from your browser, we treat it as an opt-out of analytics and marketing cookies under applicable U.S. state laws, including CPRA, and we store that choice in a first-party cookie so it persists across visits for up to one year. If you submit a form while sending a GPC signal, we record the signal with your inquiry so that we can honor your preference going forward; we still process the submission itself, including recording that the form was submitted, in order to respond to you.

We do not respond to traditional “Do Not Track” (DNT) browser signals at this time, as there is no industry consensus on how to interpret them. We do not permit third-party tracking of our visitors.

8. Your rights

Depending on where you live, you may have the rights described below. We apply each right to all visitors where reasonably practicable, regardless of location.

8.1 EEA, UK, and Switzerland

Subject to certain conditions and exceptions, you have the right to:

• Access the personal information we hold about you.
• Rectify inaccurate or incomplete personal information.
• Eraseyour personal information (“right to be forgotten”).
• Restrict or object to our processing, including for direct marketing.
• Data portability, where processing is based on consent or contract and carried out by automated means.
• Withdraw consent at any time, where we rely on consent. Withdrawal does not affect processing that took place before withdrawal.
• Lodge a complaintwith your local supervisory authority. In the UK, this is the Information Commissioner’s Office (ICO).

8.2 California and other U.S. states

If you are a resident of California, Colorado, Connecticut, Utah, Virginia, or another U.S. state that has enacted a comprehensive privacy law, you have the right, subject to verification and exceptions, to:

• Know what categories of personal information we have collected, the sources, the purposes, and the categories of recipients.
• Access a copy of the specific pieces of personal information we hold about you.
• Correct inaccurate personal information.
• Delete personal information we have collected from you.
• Opt out of sale, sharing for cross-context behavioral advertising, or targeted advertising. We do not sell or share your personal information for these purposes; our response to GPC signals (Section 7) is our primary opt-out mechanism.
• Non-discrimination for exercising your rights.
• Appeal a decision we make in response to a rights request (in states where appeal is required).

California residents may also designate an authorized agent to make a request on their behalf.

8.3 How to exercise your rights

To exercise any right described in this Section, contact us at legal@materialmotion.ai with the subject line “Privacy Request.” Please include enough information for us to verify your identity and understand your request. We will respond within the time frame required by applicable law (typically 30 days in the EEA/UK and 45 days in California).

If you are unable to contact us by email, you may write to us at the address in Section 14.

9. Data retention

We keep personal information for only as long as we need it for the purposes described in this Privacy Policy, which typically means:

• Inquiry and lead data (name, email, company, message): while we are in an active conversation with you, and for a reasonable period afterward for follow-up and record-keeping, unless you ask us to delete it sooner.
• Site analytics and error data: up to 12 months in identifiable form, after which it is aggregated or deleted.
• Legal and compliance records: as required by applicable law and our legitimate record-keeping needs.

We delete or anonymize personal information when it is no longer needed for a permitted purpose.

10. Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, access controls, vendor due diligence, and monitoring. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

If we learn of a security incident affecting your personal information, we will notify you as required by applicable law.

11. Children

The Site is not directed to children under the age of 18, and we do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us at legal@materialmotion.ai and we will delete it.

12. Links to other sites

The Site may contain links to third-party websites and services. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policy of any site you visit.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the “Last revised” date at the top of this Policy and, where appropriate, notify you by email or by posting a notice on the Site. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the updated Policy.
